How do we collect your data?
On the one hand, your data is collected when you provide it to us. This may, for example, be data you enter into a contact form or into the AI assistant. Other data is collected automatically by our IT systems when you visit the website. This is primarily technical data (e.g. internet browser, operating system or time of the page view).
What do we use your data for?
Part of the data is collected to ensure error-free provision of the website. Data you send us via the contact form or the AI assistant is used to process your request or to answer your question. We also use self-hosted, cookie-free web analytics (Umami) to create anonymous visitor statistics (see Section 4). No personal user profile is created. We use no third-party tracking and no advertising cookies.
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

Hetzner
The provider is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hereinafter "Hetzner"). The servers are located in Germany (EU). For details, please refer to Hetzner's privacy policy: https://www.hetzner.com/de/rechtliches/datenschutz.
The use of Hetzner is based on Art. 6 (1) (f) GDPR. We have a legitimate interest in presenting our website as reliably as possible.
Data processing agreement
We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Data protection
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy. Storage period
Unless a more specific storage period has been stated within this privacy policy, your personal data remains with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. tax or commercial law retention periods); in the latter case, deletion takes place after these reasons cease to apply.
Legal bases for data processing
If you have consented to the data processing, we process your personal data on the basis of Art. 6 (1) (a) GDPR. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 (1) (b) GDPR. Insofar as data is required to fulfil a legal obligation, processing is carried out on the basis of Art. 6 (1) (c) GDPR. Data processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6 (1) (f) GDPR.
Recipients of personal data
In the course of our business activities, we work with various external bodies (e.g. our hosting provider and the provider of the AI assistant). We only pass on personal data to external bodies if this is necessary within the scope of performing a contract, if we are legally obliged to do so, if we have a legitimate interest pursuant to Art. 6 (1) (f) GDPR in passing it on, or if another legal basis permits the data transfer. When using processors, we only pass on personal data on the basis of a valid data processing agreement.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to data collection in special cases (Art. 21 GDPR)
If the data processing is based on Art. 6 (1) (e) or (f) GDPR, you have the right at any time to object, on grounds relating to your particular situation, to the processing of your personal data. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.
Right to lodge a complaint with the competent supervisory authority

SSL / TLS encryption
For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser's address line changes from "http://" to "https://" and by the lock symbol in your browser line.
4. Data collection on this website
Cookies and tracking technologies
This website uses no cookies for analysis or advertising purposes and no third-party tracking technologies. There is no profiling. We use only self-hosted, cookie-free web analytics to measure reach (see "Web analytics with Umami"). In your browser’s local storage we save your chosen appearance (key "theme") and your consent to use the AI assistant (key "clesk-agent-consented-v2"). This preserves your choice for your next visit and avoids asking for consent with every message. These entries serve the functions you have expressly selected (Section 25 (2) TDDDG), do not leave your device and can be deleted in your browser settings. After a change to the processing notice, we ask for your consent again.
Web analytics with Umami (self-hosted)
We use the open-source analytics software Umami to create anonymous statistics about the use of this website (e.g. pages viewed, approximate visitor numbers and browsers used). We run Umami ourselves on our own server at Hetzner in Germany. No data is transmitted to analytics providers or other third parties.
Umami works without cookies and stores no information on your device. It records the page viewed, the referring page (referrer), browser and device type, operating system, approximate location derived from the IP address (country/region) and the time of the visit. Your IP address is not stored; it is used only temporarily to create a regularly changing, irreversible session identifier. This does not allow us to identify you or combine the information with other data.
The legal basis is our legitimate interest in anonymised usage analysis to improve our offering (Art. 6 (1) (f) GDPR). Since no information is stored on or read from your device, consent under Section 25 TDDDG is not required.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources. The collection of this data is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website. The server log files are collected for this purpose.
Contact form
If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. Where necessary to handle your request, we use technical service providers as processors (see "Recipients of personal data").
The processing of this data is based on Art. 6 (1) (b) GDPR, provided your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective handling of the enquiries addressed to us (Art. 6 (1) (f) GDPR) or on your consent (Art. 6 (1) (a) GDPR), if this was requested.
Enquiry by email or telephone
If you contact us by email or telephone, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request. Where necessary to handle your request, we use technical service providers as processors (see "Recipients of personal data"). Processing is based on Art. 6 (1) (b) GDPR, provided your enquiry is related to the performance of a contract, otherwise on the basis of legitimate interest (Art. 6 (1) (f) GDPR) or your consent (Art. 6 (1) (a) GDPR).
5. AI assistant ("clesk-agent")
This website offers an optional interactive AI assistant. It is available on the home page and through the chat window on other pages and answers questions about our agency, services and own products.
How it works and consent
The assistant only becomes active when you enter a question yourself. Before your first input is transmitted, we ask for your express consent. Only after your confirmation is your input processed. The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR.
Processing by Mistral AI
To generate the responses, we transmit your inputs (as well as the previous conversation history of the current session) to our service provider Mistral AI SAS, 15 rue des Halles, 75001 Paris, France. The processing takes place on servers within the European Union (France); there is no transfer to unsafe third countries. We have concluded a data processing agreement with Mistral AI pursuant to Art. 28 GDPR.
Logging for quality assurance
For quality assurance and to improve the assistant, we store the inputs sent to the assistant and the generated responses in server-side log files. We add no IP addresses or user identifiers to these logs. Your message may itself contain personal information, for example if you enter a name. The legal basis is our legitimate interest in the evaluation and optimisation of the assistant pursuant to Art. 6 (1) (f) GDPR.
Clearing the chat view and withdrawing consent
The /reset command clears the conversation in the current browser view. It does not delete server-side logs or withdraw consent. To remove the saved consent on your device, delete the local-storage entry described above in your browser settings and reload the page. To withdraw consent or request deletion of data already processed, you can contact us at hey@clesk.de. The storage-period information in Section 3 applies to the logs.
Note
Please do not enter any sensitive personal data (e.g. health data) or confidential information into the assistant. For a personal matter, please use our contact form.
6. Fonts
This website uses locally embedded ("self-hosted") fonts to display fonts consistently. When you call up a page, the required fonts are loaded from our server. A connection to third-party servers (e.g. Google Fonts) is not established; no personal data is transmitted to third parties.
7. What we deliberately do not do
This website does not use third-party analytics services (e.g. Google Analytics), tracking through advertising cookies, newsletter tools or embedded social media services or video platforms. The only reach measurement is cookie-free and anonymised, using the Umami software we operate ourselves (see Section 4). No data is processed for advertising purposes and no user profile is created.
